New York Guest – Terms and Conditions

Please read the following carefully. If you have any questions about any of these terms and conditions, please call us at 1-866-406-5341.  All transactions including but not limited to the sale, purchase and/or use of any services or products offered by New York Guest are subject to the following terms and conditions. The purchase, acceptance, and /or use of service(s) travel arrangements and/or product(s), in whole or in part, whichever occurs first is deemed to be consent to the terms listed on this page.

Payment

Except in the case of special arrangements or established credit terms, full payment is required at the time reservations are made and the customer's credit card will be charged immediately. All sales are considered final and there are no cancellations, refunds and/or exchanges for any reason except as noted below. All reservations are subject to changes in availability and price until the reservation has been fully paid and a final confirmation notice is issued to the client.

Ticket Pricing

All ticket pricing includes applicable fees. Face value printed on the ticket provided to the customer will be different from the total paid, as the face value does not include fees nor reflect the current market value of the ticket. By completing a ticket purchase on www.newyorkguest.com you acknowledge and agree to these terms.

Cancellations

Different components of your New York Guest reservation may carry different cancellation policies.  For specific information, please refer to the About Us /Terms and Conditions tab on the company’s web site at www.newyorkguest.com.  Cancellation and early checkout penalties apply. Early check out is also defined as a last minute cancellation and is non-refundable. To avoid charges, penalties and /or fees, the guest must receive from New York Guest, prior to the scheduled arrival or cutoff date, a cancellation confirmation number at the time of cancellation. Failure to secure a cancellation number will result in all charges and fees being charged to the guest. Please note: non-hotel items or components that have been purchased may carry different cancellation policies as detailed below

Hotel Reservations 

Cancellation penalties stated above.  Early check out is also defined as a last minute cancellation, and is non-refundable. The guest must receive a cancellation confirmation number at the time of cancellation. Failure to secure a cancellation number will result in all charges and fees being charged to the guest. Please note: other items you may have purchased as part of a travel package may carry different cancellation policies than hotel reservation cancellations.

Theatre, Sporting, Entertainment and Event Tickets

 Theatre, sporting, entertainment and event ticket sales are final and cannot under any circumstance be cancelled, refunded, or exchanged once purchased either as part of a package or as individual items. If you are no longer able to use your tickets after purchase, please see our section on re-selling tickets below. Please note: other items you may have purchased as part of a travel package may carry different cancellation policies than ticket cancellations.

Sightseeing Tours and Transportation

Sightseeing tours, transportation reservations or other services must be cancelled at least 48 hours prior to arrival date in order to be eligible for a refund, unless another earlier cancellation policy shall apply. If a voucher has been issued to the client for these services, the original voucher must be returned to New York Guest in order to process a refund. Please note: other items you may have purchased as part of a travel package may carry different cancellation policies than sightseeing and transportation cancellations.

Changes

Requests to change an existing order are subject to a per item change fee which shall vary with the changed item(s). Some items may not be changed.

Refunds

Any qualified and approved refunds in line with the conditions as stated are in the form of a US bank generated check in US Dollars and processed within 30 business days from receiving written notice of your cancellation or refund request. There is an administrative fee of $15 for all refund processing.

Re-selling Tickets

As a courtesy, the guest may request that New York Guest place their entertainment, sport or theatre tickets 'up for sale' in the event they can no longer use them. However, there is no guarantee that they will be sold. Before tickets can be placed 'up for sale', those tickets must be physically in the hands of New York Guest. If the tickets are re-sold, you will be issued a credit less a $35 per ticket service fee. If only some of the tickets in your package have been re-sold, you will be issued a partial credit, less a $35 per ticket service fee. Credit payments are in the form of a US bank generated check and processed within 30 business days from the re-sale date of the tickets. Alternatively, credits may be attributed to future purchases with New York Guest.

Seating Arrangements for Entertainment, theatre and sports tickets
Entertainment, theatre and sports tickets are filled with the best available seats at the time of purchase. Alternative seat locations may be substituted for the seat locations quoted, without notice including upgrades to better locations. Where seats are substituted, there will be no additional charge to the client. Until the transaction is fully completed, entertainment, sports and theatre tickets are subject to prior sale, unavailability, and/or blackout dates.

Responsibility and Limitations:

The responsibilities of New York Guest, LLC and/or its agents are strictly limited. New York Guest, LLC acts only as an agent in regard to travel, tour and entertainment arrangements. New York Guest, LLC assumes no liability for injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason of defect, through acts of God, war, fire, delays, rescheduling, breakdown in machinery, riots, and strikes and/or from any causes beyond the control of New York Guest, LLC. All services  are furnished by independent contractors (suppliers) and do not act for or on behalf of New York Guest, LLC. New York Guest, LLC is not liable or responsible in any way whatsoever for any act, error or omission or for inconvenience, loss, damage, injury or death arriving out of tours, entertainment, services or travel arrangements. Liability, if any, is strictly limited to the face value of the ticket, voucher or reservation. The payment, acceptance, use and or purchase of service(s) travel arrangements and/or product(s), in whole or in part, whichever occurs first is deemed to be consent to the above terms.
