Terms and Conditions; Responsibilities and Limitations
Please read the following carefully. If you have any questions about any of these terms and conditions,
please call us.
All transactions including but not limited to the sale, purchase and/or use of any services
or products offered by New York Guest are subject to the following terms and conditions. The purchase, acceptance,
and /or use of service(s) travel arrangements and/or product(s), in whole or in part, whichever occurs first
is deemed to be consent to the terms listed on this page.
Payment
Full payment is required at the time reservations are made and the customer's credit card will be charged
immediately. All sales are considered final and there are no cancellations, refunds and/or exchanges for
any reason except as noted below. All reservations are subject to changes in availability and price
until the reservation has been fully paid and a final confirmation notice is issued to the client.
Cancellations
Different elements of your New York Guest reservation may carry different cancellation policies. Please see the information
below for each reservation category.
Hotel Reservations:
Hotel accommodations must be cancelled a minimum of five (5) days prior to
your arrival, unless another earlier cancellation policy shall apply. Hotel room cancellations or changes less than five (5)
days from the date of arrival can not be cancelled, exchanged, and/or refunded. Early check out is also defined
as a last minute cancellation, and is non-refundable. The guest must receive a cancellation confirmation number at the
time of cancellation. Failure to secure a cancellation number will result in all charges and fees being charged
to the guest. Please note: other items you may have purchased as part of a travel package may carry different
cancellation policies than hotel reservation cancellations.
Theatre, Sporting, Entertainment and Event Tickets:
Theatre, sporting, entertainment and event ticket sales are final and cannot under any circumstance be cancelled,
refunded, or exchanged once purchased either as part of a package or as individual items. If you are no longer
able to use your tickets after purchase, please see our section on re-selling tickets below. Please note: other
items you may have purchased as part of a travel package may carry different cancellation policies
than ticket cancellations.
Sightseeing Tours and Transportation:
Sightseeing tours, transportation reservations or other services must be cancelled at least 48 hours prior to arrival
date in order to be eligibile for a refund, unless another earlier cancellation policy shall apply.
If a voucher has been issued to the client for these services, the original voucher must be returned to
New York Guest in order to process a refund. Please note: other items you may have purchased as part of a travel
package may carry different cancellation policies than sightseeing and tranportation cancellations.
Changes
Requests to change an existing order are subject to a per item change fee which shall vary with the
changed item(s). Some items may not be changed.
Refunds
Any qualified and approved refunds in line with the conditions as stated are in the form of a US bank
generated check in US Dollars and processed within 30 business days from receiving written notice of your cancellation or refund
request. There is an administrative fee of $15 for all refund processing.
Re-selling Tickets
As a courtesy, the guest may request that New York Guest place their entertainment, sport or theatre
tickets 'up for sale' in the event they can no longer use them. However, there is no guarantee that
they will be sold. Before tickets can be placed 'up for sale', those tickets must be physically in the
hands of New York Guest. If the tickets are re-sold, you will be issued a credit less a $35 per ticket service fee.
If only some of the tickets in your package have been re-sold, you will be issued a partial credit,
less a $35 per ticket service fee. Credit payments are in the form of a US bank generated check and processed within 30
business days from the re-sale date of the tickets. Alternatively, credits may be attributed to future purchases
with New York Guest.
Seating Arrangements for Entertainment, theatre and sports tickets
Entertainment, theatre and sports tickets are filled with the best available seats at the time of
purchase. Alternative seat locations may be substituted for the seat locations quoted, without notice
including upgrades to better locations. Where seats are substituted, there will be no additional
charge to the client. Until the transaction is fully completed, entertainment, sports and theatre
tickets are subject to prior sale, unavailability, and/or blackout dates.
Privacy Policy
New York Guest (NYG) is very interested in YOUR RIGHT TO PRIVACY. New York Guest, LLC is committed to protecting
your privacy online. That's why New York Guest has created an online Privacy Policy. We believe that your
confidence in our commitment to online privacy is a key factor in customer satisfaction.
PERSONAL INFORMATION: In order to process online orders and requests for services, NYG may request
that you provide us with personal information such as your name, address, e-mail address and phone numbers.
If you decide to purchase goods or services offered by NYG, you may need to supply us with credit card
information. Your personal information, as well as credit card information, will not be sold or distributed
to third parties unless it is required to complete travel arrangements and other purchases. All third parties
involved with NYG follow strict standards designed to safeguard your privacy.
SECURITY: The importance of security for all personally identifiable information associated with our
customers is of the utmost concern to NYG. Unfortunately, no data transmission over the Internet can be
guaranteed to be 100% secure. As a result, while NYG strives to protect your personal information, NYG
cannot ensure or warrant the security of any information you transmit to us. If you choose to submit
personal information on our web site, your information is stored in a secure profile that NYG uses to
process your travel transactions and contact you in the event of a customer service request. It may also
be used to provide you with special promotional information via e-mail. NYG is sensitive to your concerns
regarding the security of using your credit cards to purchase products and services through the Internet.
Safeguarding your privacy and confidentiality is of the utmost importance to us. Our site uses an encrypted
system for your data while it is being transferred over the Internet. This makes it more difficult for someone
to steal your credit card information.
LINKS: NYG contains links to other Web sites. Please note that when you click on one of these links,
you are entering another web site for which NYG has no responsibility. We encourage you to read the privacy
statements of all such sites as their policies may be materially different from NYG Privacy Policy. Of course,
you are solely responsible for maintaining the secrecy of your account information. Please be very careful,
responsible, and alert with this information, especially whenever you're online. In addition to the circumstances
described above, NYG may disclose member information if required to do so by law, court order, as requested by
other government or law enforcement authority, or in the good faith belief that disclosure is otherwise necessary
or advisable including, without limitation, to protect the rights or properties of NYG or when we have reason to
believe that disclosing the information is necessary to identify, contact or bring legal action against someone
who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone
else could be harmed by such activities.
Terms of Use
1. By using the New York Guest website (New York Guest), you (the user) are agreeing to the terms of use of
this site which includes, but is not limited to: New York Guest and any other services accessible via the website.
2. The content and information displayed on this web site is the property of New York Guest Inc. (New York Guest).
The downloading, reproduction, or retransmission of New York Guest content, without the express consent of a New York
Guest representative, other than for non-commercial individual use, is strictly prohibited.
3. New York Guest websites might include trademarks, copyrighted material, products or other proprietary rights of New
York Guest and/or other parties. No license to, or rights to such materials are conferred to you.
4. You agree that you will not use any device, software or other methods to interfere or attempt to interfere with the
proper functioning of our site. You will not take any action that imposes an unreasonable or disproportionately large
load on our infrastructure.
5. You agree that you will not use any robot, spider, other device, or process - whether automated or manual -
to monitor or copy the content on our web pages in part, or in whole, without the prior express consent from a
New York Guest representative (standard search engine technology used by Internet search web sites to direct
users to this site are considered to have such consent.)
6. The user must verify that all registration information is accurate and doesn't violate our privacy policy. All
user registration information is held in confidence by New York Guest in accordance to our privacy policy.
7. You are responsible for all comments that you send to, or post on the site and must adhere to the rules outlined
in our privacy policy. By sending or posting such information you are giving us permission to use the information as
promotional material on the site, our affiliates and partners' sites or in our print materials for promotional or
marketing purposes.
8. In the advent that we have a public forum or web log it is understood that you will adhere to the rules of use outlined herein and in our privacy policy. Information submitted to our forum or web log will present no harm or violation of rights to other users, the site, or our partners and affiliates; views expressed by our users are not necessarily those of New York Guest

It is the user's responsibility to review these terms of use for any changes. By continuing to use New York Guest,
the user effectively agrees to all changes thereof.
Responsibility and Limitations:
The responsibilities of New York Guest, LLC and/or its agents are strictly limited. New York Guest, LLC acts
only as an agent in regard to travel, tour and entertainment arrangements. New York Guest, LLC assumes no liability
for injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason of defect,
through acts of God, war, fire, delays, rescheduling, breakdown in machinery, riots, and strikes and/or from
any causes beyond the control of New York Guest, LLC. All services including but not limited to sightseeing
tours, transportation, entertainment, hotel accommodations, restaurant arrangements and any others are furnished
by independent contractors (suppliers) and do not act for or on behalf of New York Guest, LLC. New York Guest,
LLC is not liable or responsible in any way whatsoever for any act, error or omission or for inconvenience,
loss, damage, injury or death arriving out of tours, entertainment, services or travel arrangements. Liability,
if any, is strictly limited to the face value of the ticket, voucher or reservation. The payment, acceptance, use
and or purchase of service(s) travel arrangements and/or product(s), in whole or in part, whichever occurs first
is deemed to be consent to the above terms.
